1. Acceptance of Terms

By creating an account, connecting an Instagram profile, or using any feature on DMSeva ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. Description of Service

DMSeva provides Instagram direct messaging (DM) automation, comment auto-replies, keyword matching triggers, and subscriber capture services. DMSeva connects to your Instagram account via official Meta APIs. We do not support, permit, or facilitate unofficial scraping, password sharing, or third-party bots that violate Instagram's guidelines.

3. Account Eligibility & Connection

To connect to DMSeva, you must possess a valid Instagram Creator or Instagram Business profile linked to a Facebook Page of which you are an administrator.

• You are responsible for keeping your Meta credentials secure.
• You must be at least 18 years of age to register or purchase any premium subscription plan.
• You are solely responsible for all automated content, links, and replies sent through your account.

4. Content & Messaging Guidelines

DMSeva is designed to facilitate organic, requested link sharing and client onboarding. You agree that you will not use the Service to send:

• Unsolicited commercial messages, bulk spam, or harassing content.
• Phishing links, malware, or illicit product advertisements.
• Content that violates Meta's Community Guidelines or Developer Policies.

Violation of these content guidelines will result in immediate suspension or termination of your DMSeva account without a refund.

5. Fees, Subscriptions & Renewals

Certain features require a premium subscription plan billed monthly or annually.

• All subscriptions automatically renew at the end of the billing period unless cancelled.
• You may cancel your plan at any time through the billing dashboard.
• Charges are based on the monthly allocation of active trigger interactions and connected profiles. Overages are capped at tier limits.

6. Intellectual Property & Brand Names

All software, designs, dashboards, and materials provided under the DMSeva domain are owned exclusively by DMSeva. Instagram, Facebook, and Meta are registered trademarks of Meta Platforms, Inc. DMSeva is an independent platform utilizing Meta's officially supported APIs and is not officially endorsed or sponsored by Meta.

7. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While DMSeva uses official Meta APIs, we are not liable for any downtime, account suspensions, API modifications, or restrictions imposed by Meta Platforms, Inc. In no event shall DMSeva be liable for lost profits, lost data, or any indirect, incidental, or consequential damages.

8. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal actions or proceedings arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
